1. Acceptance
These Terms of Service ("Terms") form a binding agreement between you and HausOS Inc. ("HausOS," "we," "our," or "us") when you access or use our website, software products, homeowner experience, vendor experience, or related services.
If you do not agree to these Terms, do not use HausOS.
2. What HausOS Provides
HausOS provides software, operational tools, communications features, and onboarding flows designed to help homeowners manage home services and help vendors operate their service businesses with better context and continuity.
HausOS is a software platform. Unless we expressly state otherwise, we do not personally perform home services, supervise physical service delivery, employ vendors as our employees, or guarantee the outcome of work performed by a homeowner, vendor, or third party.
3. Accounts and Eligibility
- You must be at least 18 years old and able to form a binding contract to use HausOS.
- You agree to provide accurate information and keep it reasonably current.
- You are responsible for activity that occurs under your account and for maintaining the confidentiality of your credentials.
- You must notify us promptly if you believe your account has been accessed without authorization.
4. Homeowner Terms
Homeowners may use HausOS to request services, organize property information, keep recurring work visible, maintain service history, and communicate with vendors or support staff.
- You are responsible for the accuracy of property details, access instructions, and service expectations you provide.
- You are responsible for deciding whether a vendor is appropriate for your needs and for any agreements you make with that vendor.
- You should use good judgment and follow applicable laws, homeowner association rules, lease terms, and property restrictions when using the platform.
5. Vendor Terms
Vendors may use HausOS to manage scheduling, recurring work, client information, service notes, and related operations.
- You represent that you are qualified to provide the services you offer and that you hold any licenses, registrations, permits, and insurance required by law.
- You are solely responsible for the quality, legality, safety, timing, and completion of any services you provide.
- You must not misrepresent your business, qualifications, team capacity, or service status.
- You are responsible for your personnel, subcontractors, and anyone performing work under your direction.
6. Bookings and Payments
HausOS may provide tools related to service requests, scheduling, recurring services, contracts, and communications. Payment processing may be provided directly through HausOS, through an integrated third party, or through arrangements made between homeowners and vendors depending on the state of the platform.
- Where third-party payment tools are used, those providers may have their own terms and privacy policies.
- Unless HausOS expressly assumes a payment role, payment disputes remain between the homeowner and vendor.
- Scheduled services, cancellation expectations, and project-specific terms may also be subject to separate agreements between platform participants.
7. Acceptable Use
You agree not to:
- Use HausOS for unlawful, fraudulent, abusive, threatening, or misleading activity.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Upload malicious code, disrupt platform operations, or interfere with other users.
- Scrape, harvest, or copy platform content or data without our written permission.
- Impersonate another person or entity or misrepresent your affiliation with HausOS.
8. Content and Data
You retain ownership of content and information you submit to HausOS, subject to the rights needed for us to operate the platform.
- By submitting content, you grant HausOS a non-exclusive, worldwide, royalty-free license to host, store, use, reproduce, and display that content as needed to provide, improve, and protect the service.
- You represent that you have the rights necessary to submit the content you provide.
- HausOS and its branding, software, design, and related intellectual property remain owned by HausOS or its licensors.
9. Disclaimers and Limitation of Liability
HausOS is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee that the service will always be uninterrupted, error-free, or perfectly secure.
To the fullest extent permitted by law, HausOS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or reputational harm arising from or related to your use of HausOS.
To the fullest extent permitted by law, HausOS's total liability for claims arising out of or relating to these Terms or the platform will not exceed the greater of (a) the amount you paid to HausOS in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars.
10. Suspension and Termination
We may suspend or terminate access to HausOS if we believe you have violated these Terms, created risk for the platform or other users, or if continued access is not appropriate for legal, security, or operational reasons.
You may stop using HausOS at any time. Certain sections of these Terms, including those concerning intellectual property, disclaimers, liability, dispute resolution, and any provisions that by their nature should survive, will survive termination.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the use of HausOS will be resolved in accordance with applicable Arizona law.
To the extent permitted by law, you agree that claims will be brought on an individual basis and not as part of a class, coordinated, or representative proceeding.
12. Changes and Contact
We may revise these Terms from time to time. When we do, we will update the effective date above. Your continued use of HausOS after updated Terms become effective constitutes acceptance of the revised Terms.
