By accessing or using the HausOS platform, mobile application, website, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and HausOS Inc ("HausOS," "we," "us," or "our"), a company organized under the laws of the State of Arizona, United States.
If you do not agree to these Terms, you may not access or use the Platform. Your continued use of the Platform following the posting of any changes to these Terms constitutes your acceptance of those changes.
HausOS is a technology platform that connects homeowners with home service professionals ("Vendors" or "Service Providers"). Our Platform facilitates the discovery, booking, and management of home services including but not limited to lawn care, plumbing, electrical, cleaning, HVAC, and other home maintenance services.
Important: HausOS is a platform that connects homeowners with independent service providers. HausOS is not a home service provider, contractor, or employer of any Vendor. We do not perform, supervise, or control the services provided by Vendors. The quality, safety, legality, and timeliness of services are the sole responsibility of the Vendor providing the service.

To use certain features of the Platform, you must create an account by providing accurate and complete information. You agree to keep your account information up to date at all times.
You must be at least 18 years of age to create an account and use the Platform. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify HausOS of any unauthorized use of your account or any other security breach. HausOS will not be liable for any loss arising from your failure to protect your account credentials.
You agree to provide accurate, current, and complete information during registration and to update such information as necessary. Providing false or misleading information may result in account suspension or termination.
Homeowner accounts are for individuals who own or manage residential properties and wish to book home services through the Platform. Homeowners are responsible for:
Vendor accounts are for home service professionals who wish to offer their services through the Platform. Vendors are responsible for:
Supervisor accounts are for team members or managers designated by Vendors to oversee field operations, manage team schedules, and coordinate service delivery. Supervisors operate under the authority and responsibility of the associated Vendor account.
Homeowners can browse available service providers, view profiles and reviews, and book services through the Platform. Bookings are subject to vendor availability and confirmation.
Cancellation and rescheduling policies are established by individual Vendors and may vary. Please review the specific Vendor's policies before booking. HausOS may establish minimum cancellation notice requirements to ensure fair treatment of all parties.
The Platform supports recurring service bookings (e.g., weekly lawn care, monthly cleaning). Recurring services will automatically schedule future appointments based on the agreed-upon frequency. Either party may modify or cancel recurring services with appropriate notice as specified in the service agreement.
Certain services may require formal service contracts between homeowners and vendors. These contracts are agreements between the homeowner and vendor directly. HausOS facilitates the creation and management of these contracts but is not a party to them.
Vendors must complete the onboarding process, which may include providing business information, service capabilities, service area definitions, and team member details. HausOS reserves the right to approve or reject vendor applications at its sole discretion.
Vendors agree to maintain high standards of service quality, professionalism, and customer satisfaction. HausOS may establish minimum quality standards and take action against vendors who consistently fail to meet these standards, including suspension or removal from the Platform.
Vendors are solely responsible for obtaining and maintaining all necessary licenses, permits, certifications, and insurance required by applicable federal, state, and local laws for the services they provide. HausOS may request proof of licensing and insurance at any time.
HausOS supports the transfer of property management between homeowners. When a property is sold or management is transferred:
HausOS is not responsible for verifying property ownership during transfers. Users are responsible for ensuring transfers are legitimate and authorized.
HausOS is in the process of implementing integrated payment processing. When available:
Until integrated payment processing is available, payment arrangements for services are made directly between homeowners and vendors outside of the Platform. HausOS is not responsible for payment disputes between homeowners and vendors.
You may submit content through the Platform, including but not limited to profile information, photos, reviews, messages, and service descriptions ("User Content"). By submitting User Content, you grant HausOS a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving the Platform.
You represent and warrant that you own or have the necessary rights to submit your User Content and that it does not violate any third-party rights.
The Platform, including its design, features, functionality, source code, branding, logos, and all related intellectual property, is owned by HausOS Inc and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy.
You agree not to engage in any of the following prohibited activities:
Violation of these prohibitions may result in immediate account suspension or termination, and may also subject you to legal liability.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
HausOS does not warrant that:
HausOS is not responsible for the quality, safety, legality, or timeliness of services provided by Vendors. Any disputes regarding services should be resolved directly between the homeowner and the vendor. HausOS may, at its sole discretion, assist in dispute resolution but is not obligated to do so.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAUSOS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
In no event shall HausOS's total aggregate liability to you for all claims arising out of or relating to these Terms or the Platform exceed the greater of (a) the amount you paid to HausOS in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).
You agree to defend, indemnify, and hold harmless HausOS Inc, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Maricopa County, Arizona, and the arbitrator's decision shall be final and binding.
For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
You may terminate your account at any time by contacting us at support@hausosapp.com or through the account settings in the app. Upon termination, your right to use the Platform will immediately cease.
HausOS may suspend or terminate your account at any time, with or without cause, and with or without notice, including but not limited to:
Vendor accounts that are terminated or deleted will enter a 30-day pending deletion period during which the Vendor may contact HausOS to resolve any outstanding issues. After the 30-day period, the account and associated data will be permanently deleted in accordance with our Privacy Policy.
Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Sections relating to intellectual property, limitation of liability, indemnification, dispute resolution, and any other provisions that by their nature should survive termination shall survive.
HausOS reserves the right to modify these Terms at any time. When we make material changes, we will notify you by updating the "Last Updated" date and, for significant changes, by providing notice through the Platform or via email.
Your continued use of the Platform after any modifications to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform and terminate your account.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
These Terms, together with the Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and HausOS regarding the use of the Platform. These Terms supersede any prior agreements, communications, or representations, whether oral or written, between you and HausOS regarding the Platform.
